Terms of Service

These terms apply to VivaDicta for macOS and VivaDicta for iOS.
1. Acceptance of Terms
By downloading, installing, or using VivaDicta ("the App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the App.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use VivaDicta for personal or business purposes, subject to these Terms and your license plan (where applicable).
You may:
- Install and use the App on devices you own or control, within the limits of your license
- Use the App for personal and commercial purposes
- Use transcriptions and AI-processed text you create for any lawful purpose
You may not:
- Reverse engineer, decompile, or disassemble the App
- Redistribute, sublicense, or resell the App or your license key
- Use the App for any illegal purpose
- Remove any copyright or proprietary notices
- Share your license key with others or use it on more devices than permitted
3. Purchases and Licensing
macOS
VivaDicta for macOS offers a free trial period. After the trial, a paid license is required. Licenses are one-time purchases (not subscriptions), available in different tiers based on the number of devices:
- Solo — 1 device
- Personal — 2 devices
- Extended — 3 devices
Purchases are processed by Polar.sh. Upon purchase, you receive a license key that activates the App. We do not directly handle your payment information.

iOS
VivaDicta for iOS is currently free to use. If premium features or subscriptions are introduced in the future, they will be processed through the Apple App Store. Refunds and billing inquiries for App Store purchases should be directed to Apple.
4. User Responsibilities
Recording Consent
You are solely responsible for complying with all applicable laws regarding recording conversations. This includes:
- Obtaining consent from all parties where required by law
- Understanding one-party vs. two-party consent laws in your jurisdiction
- Complying with professional regulations in your industry
API Keys and Third-Party Services
When using cloud-based transcription or AI processing services, you must provide your own API keys. You are responsible for complying with the terms of service of those providers and for any charges incurred through your use of their services.
5. Intellectual Property
Our Rights: VivaDicta, including its code, design, and branding, is owned by us and protected by intellectual property laws.
Your Rights: You retain all rights to the content you create using VivaDicta, including your recordings, transcriptions, and AI-processed text.
6. Updates
On macOS, VivaDicta checks for updates automatically via Sparkle. On iOS, updates are delivered through the App Store. Updates may include bug fixes, new features, and security improvements. You can choose to install updates or continue using your current version.
7. Disclaimers
VivaDicta is provided "as is" without warranties of any kind, either express or implied.
- Accuracy: We do not guarantee the accuracy of transcriptions or AI-processed text. You should always verify important content.
- Availability: We do not guarantee uninterrupted access to cloud services, which depend on third-party providers.
- Data Loss: While we design the App to be reliable, we are not responsible for data loss. We recommend backing up important transcriptions.
- Third-Party Services: VivaDicta integrates with third-party AI services and CLI tools. We are not responsible for any charges, account restrictions, or other consequences arising from your use of these services. You are responsible for complying with each provider's terms of service.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of VivaDicta.
9. Termination
You may stop using VivaDicta at any time by deleting the App from your device. We may terminate or suspend your access to the App for conduct that we believe violates these Terms. On macOS, termination may include deactivation of your license key.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
